Local Counsel & Cross-Border Evidence

A CCF case often depends on documents held in another jurisdiction: a national criminal file, a civil case, an appeal, a public register or an extradition judgment. Those records cannot always be obtained or interpreted from abroad.

Why national expertise matters

Local counsel may be needed to understand the procedural status, identify lawful access routes, obtain certified decisions and interpret the effect of national rulings. No international consultant replaces a licensed local advocate where national procedural rights or court representation are involved.

How cross-border coordination works

  1. Jurisdiction map

Which countries and authorities hold potentially relevant records.

  2. Scope of instructions

Lawful research questions, with authorisation, confidentiality and eligibility confirmed for each lawyer.

  3. Primary documentation

Records obtained where permissible, with provenance, certifications and translations preserved.

  4. Independent relevance review

Domestic procedural findings separated from facts relevant to INTERPOL data processing.

  5. Consolidated chronology

A documented cross-border timeline for instructed CCF counsel to evaluate.

Example workstreams

  • Clarifying whether an investigation is pending or terminated.
  • Obtaining a complete reasoned national judgment.
  • Identifying procedural events after the original CCF decision.
  • Documenting a change in the official case status.
  • Verifying translations and spotting factual discrepancies across countries.

Deliverables and boundaries

Work plan

Jurisdiction by jurisdiction.

Document inventory

What exists, what was obtained, what is pending.

Timeline

Events across countries in one chronology.

Coordination memo

Who does what, under which instructions.

Boundaries

Availability and timelines depend on local law. We cannot promise access to non-public files or influence over authorities, and we do not represent clients in foreign courts without the required authorisation and qualified lawyers.

FAQs

Can this work with my existing international law firm?

Yes, potentially. A scoped research assignment can be coordinated with counsel already instructed, with consent and conflict checks.

Can you obtain confidential prosecution files?

Only where legal access exists through authorised procedures. It varies by jurisdiction.

Will new local documents automatically secure a revision?

No. Their discovery date, authenticity and material relevance need an independent Article 42 assessment.

Start with the decision you have

If your CCF application was refused, do not assume a second filing can simply repeat what has already been considered. A confidential assessment can identify whether a new factual basis appears to exist.
